Affiliate Agreement

Section 01

The sections below outline the topics the finalized agreement will address, so prospective affiliates know what to expect. None of the descriptions on this page create rights, obligations, or commitments for either party until a final agreement is published and accepted.

Section 02

Scope of the program

This section will define the affiliate program itself: who may participate, what it means to be an approved affiliate of TK Capital Solutions, the services referrals may relate to (credit repair and business funding consulting), and the fact that affiliates are independent parties — not employees, agents, or legal representatives of TK Capital Solutions.

Section 03

Referrals and submissions

This section will describe how referrals are made and handled: submitting client information through the affiliate portal, the affiliate's responsibility to have the client's permission before submitting their information, accuracy of submitted information, and how TK Capital Solutions attributes a submitted deal to the referring affiliate.

Section 04

Commissions

This section will cover how affiliate compensation works. Commissions are set per-affiliate by TK Capital Solutions and documented in the affiliate's portal. The finalized agreement will describe when a commission is earned (generally, when a referred deal funds), how and when payments are made, and how disputes about commission amounts are handled.

Section 05

Confidentiality of client information

This section will set out the affiliate's obligations regarding client information: using client data only for the purpose of making and supporting referrals, keeping it confidential, not selling or sharing it with third parties, and complying with applicable privacy laws. It will also reference TK Capital Solutions' own Privacy Policy.

Section 06

Term and termination

This section will explain how long the agreement lasts and how it ends: that participation begins upon approval by TK Capital Solutions, that either party will be able to end the relationship, the grounds on which TK Capital Solutions may suspend or terminate an affiliate account, and what happens to pending referrals and unpaid commissions when the relationship ends.

Section 07

No guarantees of approval or funding

This section will make clear that TK Capital Solutions does not guarantee that any referred client will be approved for services, approved for funding, or funded in any particular amount or timeframe — and that affiliates must not make such guarantees to clients on TK Capital Solutions' behalf.
